ContentHub User Terms and Conditions

These Terms and Conditions (“Terms”) govern access to and use of the ContentHub platform operated by MTN Eswatini.

By accessing, browsing, subscribing to, or using ContentHub, you (“User” or “Customer”) agree to have read the terms with understanding and are to be bound by these Terms.

1. ABOUT CONTENTHUB
  1. 1.1ContentHub is a digital content platform that allows users to access audio and video content published by independent content creators (“Creators”) through paid, on-demand subscriptions.
  2. 1.2MTN provides ContentHub strictly as a technology and distribution platform.
2. PLATFORM ROLE & DISCLAIMER
  1. 2.1MTN does not create, own, or control the content made available on ContentHub and does not endorse any opinions, views, statements, or representations expressed by Creators.
  2. 2.2All content reflects the personal views and creative expression of the respective Creator and does not represent the views of MTN.
3. USER ELIGIBILITY
  1. Users must be legally capable of entering into binding agreements and must comply with all applicable laws and these Terms.
4. SUBSCRIPTIONS & ACCESS
  1. 4.1Subscription Model
    1. 4.1.1ContentHub operates on a channel-based subscription model. Subscriptions grant access only to the specific channel subscribed to and not to the entire platform.
  2. 4.2Subscription Options
    1. 4.2.1Daily subscription: E3.00 - access for 24 hours;
    2. 4.2.2Weekly subscription: E10.00 - access for 7 days; and
    3. 4.2.3Monthly subscription: E20.00 - access for 30 days.
  3. 4.3Subscriptions provide access to all available content (free and premium) within the subscribed channel.
  4. 4.4On-Demand Subscriptions (No Auto-Renewal)
    1. 4.4.1All subscriptions are on-demand only. There are no automatic renewals or recurring charges. Subscriptions expire automatically at the end of the selected periodc, unless the customer chooses to resubscribe.
5. PAYMENTS & BILLING
  1. Subscription fees are payable upfront using MTN-supported payment methods. Fees are non-refundable except where required by law or those that may have not been deducted via an intentional subscription attempt by the user/customer.
6. NO REFUNDS OR TRANSFERS
  1. Subscriptions are non-transferable and unused subscription time is not refundable.
7. CONTENT AVAILABILITY
  1. MTN does not guarantee continuous availability of any specific content. Content may be removed or restricted due to creator decisions, policy violations, or legal requirements.
8. CONTENT USAGE RESTRICTIONS
  1. 8.1Subscription Model
    1. 8.1.1All content on ContentHub is provided for streaming only.
  2. 8.2Content may not be:
    1. 8.2.1Downloaded;
    2. 8.2.2Copied;
    3. 8.2.3Recorded; and
    4. 8.2.4Redistributed or shared without authorization.
  3. 8.3Users are encouraged to respect creators by refraining from recording or reproducing content, as such actions unfairly deprive creators of their hard-earned income.
9. ACCEPTABLE USE
  1. Users must not misuse the platform, bypass subscription controls, or engage in unlawful or harmful conduct.
10. PROHIBITED CONTENT DISCLAIMER
  1. ContentHub does not permit nudity, sexually explicit material, hate speech, discrimination, violence, or illegal activity. Users are encouraged to report such content.
11. USER DISCRETION & RISK
  1. Users consume content at their own discretion and risk. MTN does not warrant the accuracy or suitability of creator content.
12. LIMITATION OF LIABILITY
  1. 12.1MTN shall not be liable for losses arising from creator content, service interruptions, or user reliance on such content.
  2. 12.2To the maximum extent permitted by law, MTN shall not be liable for:
    1. 12.2.1indirect, consequential, special, or punitive damages;
    2. 12.2.2loss of income, profits, data, or goodwill;
    3. 12.2.3reliance on creator generated content;
    4. 12.2.4unavailability caused by maintenance, upgrades, failures, or circumstances beyond MTN's control.
  3. 12.3MTN's total aggregate liability for any claim arising from the User's use of ContentHub shall not exceed the total subscription fees paid by the User in the preceding thirty (30) days.
13. TERMINATION OF ACCESS
  1. MTN may suspend or terminate access for breach of these Terms. Termination does not entitle the user to a refund.
14. INTELLECTUAL PROPERTY
  1. Platform branding and systems are owned by MTN. Creators retain ownership of their content.
15. CHANGES TO TERMS
  1. MTN may update these Terms from time to time. Continued use constitutes acceptance.
16. GOVERNING LAW
  1. These Terms are governed by the laws of the Kingdom of Eswatini.
17. CONTACT & SUPPORT
  1. Users may contact MTN through official support channels for assistance.
18. DATA PROTECTION & PRIVACY
  1. 18.1MTN Eswatini processes personal information in accordance with the Data Protection Act, 2022.
  2. 18.2By using ContentHub, the User consents to the collection, use, storage, and processing of their personal information for purposes including:
    1. 18.2.1subscription activation and management;
    2. 18.2.2payment processing;
    3. 18.2.3fraud prevention and security;
    4. 18.2.4customer support and service improvement; and
    5. 18.2.5compliance with legal and regulatory obligations.
  3. 18.3MTN shall take reasonable technical and organisational measures to safeguard personal information against loss, misuse, unauthorised access, alteration, or disclosure.
  4. 18.4Users acknowledge that MTN may share personal information with authorised third parties—including payment processors, system providers, and regulatory authorities—strictly for lawful and operational purposes.
  5. 18.5Users may exercise their rights (access, correction, objection, deletion) by contacting MTN through official customer care channels.
  6. 18.6Further details are available in MTN's Privacy Notice, which forms an integral part of these Terms.
19. INDEMNITY
  1. 19.1The User indemnifies and holds harmless MTN, its directors, employees, affiliates, and service providers from any claims, losses, damages, liabilities, penalties, costs, or expenses arising from:
    1. 19.1.1the User's breach of these Terms;
    2. 19.1.2the User's misuse of the platform or attempts to bypass access controls;
    3. 19.1.3violation of any applicable law; or
    4. 19.1.4use or reliance on creator content.
  2. 19.2This indemnity survives termination of the User's access to ContentHub.
20. DISPUTE RESOLUTION
  1. 20.1MTN encourages Users to first resolve any concerns through MTN Customer Support.
  2. 20.2If the matter remains unresolved within fourteen (14) days, it shall be referred to conciliation or mediation administered by the Eswatini Communications Commission (ESCCOM) or another mutually agreed forum.
  3. 20.3If mediation fails, the dispute shall be finally resolved by arbitration in Eswatini, in accordance with the Arbitration Act, 1904.
  4. 20.4Each party shall bear its own costs, and the parties shall equally share the mediator or arbitrator's fees unless directed otherwise.
21. MODIFICATION OF SERVICE
  1. 21.1MTN may modify, suspend, or discontinue features of ContentHub for operational, security, technical, regulatory, or business reasons.
  2. 21.2MTN will take reasonable steps to notify Users of significant changes where practicable.
  3. 21.3Continued use of ContentHub constitutes acceptance of such modifications.
